Trade Facilitation - Case 4: New Model Cross-border E-business Regulation

China  Pilot Free Trade Zone (hereinafter referred to as Guangdong Pilot Free Trade Zone) explores the new model of cross-border e-business regulation, to simplify the port procedures, to strengthen the supervision in and after the process and to build a quality traceability system; the closed-loop supervision and management, such as the advance evaluation, entry recording, the third party's inspection and afterwards tracing, is implemented on the cross-border e-commerce enterprises and products, to effectively promote the development of the cross-border e-business industry in the zone.

I. Main practice

The customs, inspection and quarantine departments of Guangdong Pilot Free Trade Zone take the lead with the assistance of the commerce department and development and reform commission, to actively build the new model of cross-border e-business management of recording before the process, information collection in the process and tracing after the process.

(1) Implementing filing management of cross-border e-business enterprises and products.

The e-business enterprises in the zone should first apply for the recording at the customs, inspection and quarantine departments, which may be done via online registration form, and the policy of "filing in a point shall apply in the whole process" should be implemented. Any enterprise completing confirmation on any business site in Guangzhou and Shenzhen customs area can carry out related business on other sites of the customs area, without re-filing formalities.

The e-business enterprise should submit the commodity registration information to the inspection and quarantine department before first sales of the commodity. For the record of general-risk commodities, only the information such as the name of commodity, brand, HS code, specifications, country of origin, name of supplier need be submitted; in the record of exit commodities, only the information such as the commodity name, HS code and country of origin need be submitted. Re-filing is not needed for entry and exit again of the registered commodities of the same enterprise.

(2) Implementing all-declaration management on the e-business commodity entry and exit.

All-declaration management refers to that the owner, agent, carrier or production unit of the containers, goods, scrap material, packages, items and transport facilities for entry and exit should perform the declaration obligation with the inspection and quarantine organ in accordance with the relevant laws and regulations on the inspection and quarantine. All-declaration information of the exit e-business commodity includes the commodity information, enterprise information, order information, e-business platform information, etc.; all-declaration information of the entry e-business commodity includes the commodity information, enterprise information, e-business platform information, order information, payment information, logistics information and traceability information (such as commodity bar code or QR code). Where the batch of e-business commodities enter and are stored centralized and are sold as per batch according to the order, the commodity information and enterprise information should be declared before entry; in the storehouse leaving declaration, the order information, payment information, logistics information, consumer information and self-use commitment information should be submitted.

(3) Implementing the fast customs clearance mode of "taxation after pass" on bonded goods imported.

Before the cross-border e-business import pilot enterprise carries out the pilot business, a bank guarantee should be submitted to the customs as taxes guarantee. The bonded goods imported should be declared in regulatory way of "Cross-border trade e-commerce"; before the bonded goods enter the cross-border e-commerce warehouse, the enterprise should send the warehouse inventory data to the cross-border customs clearance system. After the warehouse inventory is settled, the enterprise with manifest deals with the formalities of goods receiving in the dock and the goods should be warehoused after the sealing. Where the bonded goods leaving the warehouse are transported to the area and transferred into formal import, the enterprise should send an electronic inventory data to the cross-border customs clearance system. After the enterprise receives the feedback on approval of the import electronic listing data, the application of loading list approval should be sent by cross-border customs clearance system. After the approval of the loading list, the actual logistics distribution of the goods can be carried out. The customs implements the classified management on the cross-border e-commerce and explores "taxation after approval" mode, which means that, the customs shall discharge the commodity with the guarantee, and the e-business and logistics enterprises will withhold the tax regularly; the majority of commodities with low risk will provided with quick discharge, to improve the customs clearance efficiency. At the same time, the 7 x 24 hours discharge & operation procedures should be developed for the cross-border e-business goods and the 7 x 24 hours discharge area should be set up for the cross-border e-business goods.

(4) Establishing cross-border e-business quality tracing system.

Guangdong Inspection and Quarantine Bureau establishes the first cross-border e-business quality traceability platform relying on the public service platform of "Intelligent inspection port"; the quality information of the cross-border e-business goods via the Nansha Area of Guangdong Pilot Free Trade Zone can be searched in the intelligent inspection port public service platform. The consumer can input the order number, courier number or an id number to quickly inquire the name of commodity, quantity, article number, country of origin, production enterprise, port of entry and the information of a total 18 items and to achieve "source and follow-up traceable".

(5) Promoting the third party information collection system of the cross-border e-business.

The inspection and quarantine department combines the information collection of the third party and the quality traceability system, to make the product traceability chain extended to overseas. If a third party overseas inspection agency certified by CNAS issues the certificate of quality traceability, the inspection and quarantine department should provide the green channel for the imported goods and should input the quality information, data and logistics information into the "Intelligence inspection port", to get the "Birth certificate" of the imported goods and to gradually establish a global product quality database, supporting the consumers' online query.

II. Practical effect

(1) Facilitating the enterprise declaration.

The enterprise can realize the online declaration, query and recording at any place with Internet, without downloading of any application. The online 24 hours paperless working and the "Six zero declaration" of "Zero paper, zero distance, zero obstruction, zero threshold, zero cost, zero time" is achieved.

(2) Greatly improving the inspection and quarantine efficiency.

The time for the commodity inspection and quarantine is shortened to 16 minutes from 2 - 3 days; the product qualified rate is increased by 24% and the inspection rate is reduced by 90%. On-site inspection is exempt for the goods with low risk and good faith of enterprise. The majority of the container can be processed within 1 minute.

(3) Implementing "Source and follow-up traceable" of the commodity.

The establishment of product traceability platform facilitates the consumer to know the source of goods, inspection and quarantine process and the quality information of the commodity, which effectively solves the problems of the cross-border e-business product hard to trace and claim and establishes an open, transparent and convenient channel for the cross-border electrical goods tracing and rights protection. As of October 20, the cross-border e-business quality traceability online query volume in Nansha Area reached more than 28,000 times.

(4) Obtaining obvious development effect of cross-border e-business industry.

From January - August 2015, 334 cross-border e-business enterprises of Nansha Area have completed the registration, including 43,687 types of commodities and a total of 1.531 million batches of cross-border e-business goods with the worth of 430 million Yuan; Qianhai & Shekou Area has accepted the cross-border e-business goods with the worth of 430 million Yuan in the first three quarters, which is 48.5 times of that of 2014. Guangdong Pilot Free Trade Zone has become an important area of large domestic e-business enterprise arranging the cross-border e-business. The domestic well-known electric business platforms, such as Tmall International, Jingdong, Amazon, Suning, Yihaodian, Vipshop, Dangdang and Jumei, have settled here.

III. Working thought of next step

In the operation process of the cross-border e-business information management platform, the platform process should be further improved and various regulatory links such as the enterprise recording, goods recording, all-declaration and risk monitoring should be optimized, to promote healthy and rapid development of the cross-border e-business industry.
